Juvenile Justice Reform Essay LawJuvenile Justice ReformMassachusetts Juvenile Justice Reform: A Step in the Wrong DirectionJuvenile JusticeTHESIS STATEMENT: The Great and General Court of Massachusetts has erredin reforming the juvenile justice system by implementing policies andprocedures that will harm juveniles and place society at risk. On July 23, 1995, an intruder brutally attacked and stabbed JanetDowning approximately 100 times in her Somerville home. The revoltingDowning murder and ensuing arrest of Edward OBrien Jr., a 15-year-oldjuvenile whom prosecutors say committed the heinous crime, sentshockwaves through the state. When Somerville District Court Judge PaulP. Hefferman ruled that the Commonwealth try Mr. OBrien as a juvenile,those shockwaves grew in intensity, and the citizens of Massachusetts,fed up with increasing youth violence and perceptions of an ineffectivejuvenile justice system, demanded the enactment of tough new laws todeal with repeat and violent juvenile offenders. The Great and GeneralCourt of Massachusetts headed these demands for reform of the juvenilejustice system and enacted legislation that, among other things,abolishes the trial de novo system in the juvenile courts, requires thetrial of juveniles charged with murder, manslaughter, aggravated rape,forcible rape of a child, kidnaping, assault with intent to rob ormurder and armed burglary in adult court and permits prosecutors to opento the public juvenile proceedings when they seek an adult sentence. Although proponents tout these measures as a sagacious solution for thevexatious problem of juvenile delinquency, abolishing the trial de novosystem, providing for automatic adult trials and opening juvenileproceedings to the public when prosecutors seek an adult sentence worksto the detriment, not the benefit, of juveniles and society. Therefore,the policy makers of Massachusetts should repeal most sections of theJuvenile Justice Reform Act and develop other policies to deal with therising problem of juvenile crime. I. A SINGLE TRIAL SYSTEM PREVENTS COURTS FROM PROVIDING RAPID ASSISTANCETO JUVENILES IN NEED, DOES LITTLE TO SERVE JUDICIAL ECONOMY AND PLACES ASIMILAR BURDEN AS THE DE NOVO SYSTEM ON VICTIMS AND WITNESSES. Proponents of a single trial system for juveniles argue that the trialde novo system wastes judicial resources by giving defendants a secondbite at the apple and traumatizes victims and witnesses by forcing themto testify at two proceedings. However, these proponents fail toacknowledge that the de novo system allows judges to quickly providejuveniles with the rehabilitative help they need. The proponents,unsurprisingly, also fail to acknowledge that a single trial system mayplace a greater burden on judicial resources and a similar burden onvictims and witnesses. The de novo system benefits juveniles by encouraging bench trials,which frequently result in the swift administration of rehabilitativehelp. For many juveniles, delinquency is a reaction to a variety ofsituational stressors. Statistics indicate that the vast majority ofjuvenile delinquents are exposed to abuse and neglect, harsh or erraticparenting, and socioeconomic deprivation. Experts believe that if thejuvenile justice system is to rehabilitate juveniles and make themproductive members of our society, it must address these problems asswiftly as possible. A de novo system encourages juveniles, many ofwhom want judicial help, to request a bench trial. Likewise, under a denovo system, defense attorneys are encouraged to recommend an initialbench trial because the courts decision does not bind clients if it isnot in their interest.On the other hand, a single trial systemdiscourages juveniles and defense attorneys from requesting a benchtrial.Because jury trials are more lengthy than bench trials and maydrag out for over a year, the current policy of encouraging juveniles toseek an initial jury trial denies them the rehabilitative help they needfor a significant period of time. Therefore, the de novo system is thepreferred choice when dealing with juveniles because it encourages benchtrials and, concomitantly, the swift administration of rehabilitativehelp.As noted earlier, one of the primary arguments for doing away with thede novo system is that it wastes judicial resources. However, uponcloser examination one realizes that the de novo system actuallyfurthers judicial economy. Under a de novo system, proceduralsafeguards can be done away with or relaxed at bench trials without fearof violating rights of defendants. Courts have found the elimination ofprocedural safeguards at bench trials in a de novo system to beconstitutional because the judiciary will extend all safeguards to thedefendant at a new jury trial if he/she so chooses. Although nostatistics could be found which indicate the number of defendantsappealing de novo bench trial decision, a court employee estimates thatit was around 3%. Thus, 97% of juvenile cases were disposed of throughbench trials, which are less costly and time consuming than jurytrials.While 3% of the cases resulted in two proceedings, the valueobtained from bench trials appears to significantly outweigh the costsincurred by appeals. Therefore, the de novo system may actually furtherjudicial economy more than a single trial system. The other primary argument for a single trial system is that makingvictims and witnesses testify at two trials is unfair. The 3% estimatethat the de novo system requires that victims and witnesses testify attwo trials very infrequently. Furthermore, replacing the de novo systemwill not eliminate the need for requiring some victims and witnesses totestify at two trials. Appellate courts have the power to reverse atrial courts decision and order a new trial. In cases where the trialcourts decision is reversed, victims and witnesses must testify again. Given the strong state interest in reforming juveniles, protectingsociety and conserving judicial resources and the fact that a one trialsystem also requires some victims and witnesses to testify twice, theburden placed on witnesses and victims by the de novo system cannot beconsidered unreasonable. In sum, the de novo trial system better suits the needs of juvenileoffenders, society and the court system for several reasons. First,under the de novo system, judges can expeditiously provide therehabilitative help that juveniles need. Secondly, the de novo systemdoes not appear to burden judicial economy. In fact, despiteproponents claims to the contrary, the evidence appears to indicatethat a de novo system actually furthers judicial economy. Finally,although a slight burden is placed on those victims and witnesses whoare forced to testify at two proceeding, this burden exists in a onetrial system and is outweighed by the strong state interest inrehabilitating juveniles, protecting society and conserving judicialresources. Mental Health and Managed Care EssayThe section of the Juvenile Justice Reform Act that allows the openingof juvenile hearings to the public where an adult sentence is soughtwill expose some juveniles to public scrutiny even though theyultimately receive a juvenile sentence. Currently, a Massachusettsprosecutor has the option of opening juvenile proceedings to the publicby seeking an adult sentence. Although prosecutors seek an adultsentence, the judge still has the discretion to sentence the offender asa juvenile after a post-trail amenability to rehabilitation hearing. Thus, it is entirely possible and probable that a number of cases injuvenile court which result in a juvenile sentence will be open topublic scrutiny. Such a system is unfair because it allows prosecutorsto throw open the doors of secrecy in juvenile court even if there islittle chance of an adult sentence being imposed. Opening juvenile proceedings to the public also results in juvenilescarrying around the taint o f criminality which may lead to recidivism. Generally, proceedings in juvenile court have been closed to the publicand press to prevent the stigmatization of minors and encouragerehabilitation. Allowing prosecutors to open juvenile judicialproceedings to the public will undermine rehabilitative efforts bycreating a self-perpetuating stigma of delinquency, placing anaccompanying stigma on family members, which could impair the juvenilesfamilial relationships, encouraging youths to commit crimes forpublicity or attention and contributing to a deterioration in thejuveniles interaction with his peers, the educational system and thesurrounding community. Because prosecutors are frequently unconcernedwith the interests of juveniles and cater to public sentiment, thedecision to open juvenile judicial proceedings should be left in thehands of an impartial decision maker. To summarize, prosecutors should not have the option to open juvenileproceedings where they seek an adult sentence to the public because itis unfair to juveniles who receive juvenile sentences and underminesrehabilitative efforts. Opening hearings to the public in juvenilecourt when the prosecutor seeks an adult sentence will result in somecases being held subject to public scrutiny even though the judgeimposes a juvenile sentence. Such an arrangement is unfair to juvenileswho are amenable to rehabilitation in the juvenile system. Additionally, opening juvenile hearings to the public is likely toundermine rehabilitative efforts by creating a self-perpetuating stigmaof delinquency, placing an accompanying stigma on family members, whichcould impair the juveniles familial relationships, encouraging youthsto commit crimes for publicity or attention and contributing to adeterioration in the juveniles interaction with his peers, theeducational system and the surrounding community. Therefo re,prosecutors should not have the power to open juvenile court proceedingsto the public by seeking an adult sentence. IV. CONCLUSION AND RECOMMENDATIONSThe Massachusetts Great and General Court, in attempting to reform thejuvenile justice system, has embarked upon a noble and worthwhileendeavor. However, the reforms instituted by the legislature are theproduct of faulty perceptions and erroneous beliefs rather than informedpolicy making. If the citizens of Massachusetts are truly interested inchanging the juvenile justice system for the better, it is not too lateto petition the legislature to repeal and amend the detrimental sectionsof the Juvenile Justice Reform Act. The citizens of Massachusetts couldalso contact their representatives and ask them to introduce newlegislation that benefits both juveniles and society. One may wonder that if the Juvenile Justice Reform Act is bad publicpolicy, what policies should be implemented to reform the juvenilejustice system. Perhaps the first step our legislature should take isto implement preventative programs, such as parenting classes, afterschool and summ er athletic programs and academic intervention, to keepjuveniles from entering the juvenile justice system in the first place. Not only are such interventions and programs effective, they are alsocheaper than incarceration. The average yearly cost of incarcerating ajuvenile ranges from $35,000 to $64,000. On the other hand, the averagecost of academic intervention is approximately $4,300 and a year atHarvard costs $30,000. Therefore, for the amount that it takes toincarcerate one juvenile for a year, the Commonwealth could preventapproximately 14 juveniles from entering the juvenile justice system. In addition to implementing preventative programs, Massachusetts shouldexamine the rehabilitation programs and measures of other states andadopt those that are effective. Although most states have moved towardrecognizing punishment and accountability as the goals of the juvenilejustice system, no state has entirely eliminated the philosophy ofrehabilitation. Many of these states have proven rehabilitationprograms and measures in place. For instance, Utah has founded theIntermountain Specialized Abuse Treatment Center in Salt Lake City torehabilitate juvenile sex offenders, and California has established bootcamps for juvenile delinquents. By examining the rehabilitationprograms of other states and adopting those that are effective,Massachusetts could design a new and successful rehabilitation systemfor juveniles. A third and more practical possibility is that Massachusetts couldincrease funding to its existing juvenile rehabilitation system. In1989, the Massachusetts Department of Youth Services, an agency devotedto helping youths choose productive, crime-free lives, while keeping thepublic safe, was named the best juvenile agency in the United States bythe National Council on Crime and Delinquency. However, several yearslater the Department of Youth Services came under fire when severalyouths in its custody died, and a youth who was away without leaveparticipated in a double murder. Officials at the Department of YouthServices maintain that the agency has fallen into disarray as a resultof budget cuts and overcrowding. Thus, by increasing the budget of theDepartment of Youth Services, the Commonwealth can restore the agency toits former prominence and, at the same time, add vitality to thephilosophy of rehabilitation in the juvenile justice system.

In both the main characters go into their house to protect themselves but before they do that they board their houses for extra protection. Unfortunately in both the story and the film they did not do a good enough job boarding up their houses because the birds get into an upstairs room. Political Theatre Essay Modernism came about due to a change in international thinking, with the likes of Darwins evolution theory and the publication of Karl Marxs The Communist Manifesto (1848). People wanted a clean break with tradition, presented through the arts as Romanticism and realism. Consequently, Modernism an artistic experiment and immensely complex movement encompassed the majority of the countries in the Western World, after figures in the avant-garde of the movement, such as Zola and Nietzsche, spread out from the bohemian cities of Paris and Vienna, where Modernism stemmed from. Modernism is an Umbrella term, an overwhelmingly complex phenomenon1, including Naturalism, Symbolism and Theatre of the Absurd among others. It also began throughout the world at different times forming a number of different strands, such as Germanic and Anglo-American Modernism. It is for this reason that the movement is so difficult to pin down to one era. According to Bradbury and McFarlane, it began in 1880 and ended in the 1930s. However, among other critics, I propose that the period stretches further, much closer to the present day, where we are currently in the period of Post-Modernism. It is certain that Modernism began in the 1880s, making a swift transition from Romanticism. It was concerned with a negative consciousness, alienating the audience and creating a sense of disorder. Yet, this quickly gave way to a positive attitude to social advance, seen in Henrik Ibsens plays, highlighting optimism and confidence. Shortly after came the main strand of Modernism, replacing this confidence with a fascination with irrational forces, reflected in Strindbergs The Ghost Sonata. The movement juxtaposes a number of unlikely combinations such as The Enlightenment (18th Century) and Romanticism (early 19th Century); rational and irrational thought; and the naturalistic and symbolic because of its complexity and the range of different styles within it. The central point for Modernism changed at the end of World War I, moving away from France in favour of Central Europe and revolutionary Russia. The change in politics, society and technology called for developments in theatre, the product being Political Theatre. However, the term Political Theatre was first used publicly in 1928, before which it had no official term. Political Theatre, like the rest of Modernism posed a number of experimental, and often controversial ideas. The two main forerunners of Political Theatre were Germans, Erwin Piscator and Bertolt Brecht. Piscator set the ball rolling, adapting plays to have a political edge, while Brecht developed the ideas and formed stronger concepts and theories, writing his own plays with political subject matters. Yet, the practitioners didnt work together in developing the style despite sharing similar beliefs in how theatre should be portrayed, because each man wanted to manage himself. Ironically, this situation is echoed in the politics of the time with the Russian and German Revolutions, where despite the parties seizing power in similar manners and setting out from the same causes, they didnt share views in ideology. At the end of World War I Germany was in a state of economical and political ruin. The Weimar Republic took control of Germany until just before World War II after which Hitler effortlessly seized power. The artists of The Weimar Republic, home of Political Theatre, were anti-Nazi and sought to find policies to suit them elsewhere. As a result, strong allegiances were built with Russia, and many artists of the Modern era migrated there to find jobs. Piscator was a revolutionary Marxist; he disliked the Nazis and produced many political plays attacking the regime. However, Piscators theatre was subject to party orders and the political issues of the time. Brecht, like Piscator was opposed to Militarism and false Nationalism. He despised Nazism and as a result was exiled for fifteen years, where he wrote some of his most famous work including The Good Person of Szechwan and Mother Courage. Yet, unlike Piscator, he never joined the East German Communist Party despite following the Marxist regime, which was mainly based in Russia. Two forms of theatre that had been set up in Russia, largely influenced by the works of Meyerhold, set the basis for Piscators Epic theatre of Politics. Agitation Propaganda (Agit-Prop) aimed to stimulate the audience to take political action, through the use of song and short sketches. The other, Mass spectacles, were vast pageants of revolution involving casts of thousands 2. It has been suggested that Piscators Epic theatre was a fusion of these two elements. However, his theatre is not Naturalism. He uses aspects of previous forms, fitting them into Political Theatre. He is more sympathetic towards Naturalism because it shows real people on stage, but claims the problems is that cries of exasperation stand where we should hear answers 3, this being the difference. However, where Piscator scattered the pieces, Brecht was the one to pick them up and create the jigsaw. Brecht drew his own ideas from Piscators, simplifying and customising them. Piscator wanted to create a new form of theatre, one that engulfed the social struggle, where the Proletariat take power from the ruling class, another link with Marxist Russia during World War I (1917). He wanted his audience, preferably the working class, to take a stand as a result of his theatre. Piscator once said More than ever the theatre must nail its flag fanatically to the mast of politics: the politics of the proletariat Theatre is action, the action of the proletariat4 His theatre aimed to depict reality as truthfully and authentically as possible, providing a documentary style reality to the drama. This had repercussions on future Art, because this idea formed the basis for Documentary Theatre. In order to portray this new theatre, there came a need for a new style of acting, and not only this but a totally different approach to performance. A critic described one of Piscators early productions, Fahnen, as epic, and consequently he built on this idea. Thus the beginnings of Epic Theatre were first outlined in his published book, Das Politische Theater in 1929. It is now appreciated that Political and Epic Theatre go hand in hand. However, the real theorist of Epic Theatre was Brecht. Naturally, he was influenced by Piscator, but used his methods on a much smaller scale. As Willett said The real novelty [of Brechts theatre] and force of his plays lay in the words which simply could not stand such top-heavy staging5 and therefore focussed his work on die Verfremdungseffekt, a technique he created that made the acting strange to the audience. In doing this, Brecht took the emotion out of the production, distanced the audience from the characters, and most importantly made the actors dissociate themselves from their roles. The staging of Political Theatre aimed to enhance the technique and theories of the movement as a whole. It depended on a minimum of scenery and props, following the ideals that the spectacle of the theatre is in the acting and what the actors can portray. Brechts Mother Courage is a good demonstration of how small greedy entrepreneurs make wars possible. Brecht states this in no uncertain terms in the play What they could do with round here is a good war. What else can you expect with peace running wild all over the place? You know what the trouble with peace is? No organization. 6 portraying his views on the senselessness of war. The play tells the story of a woman who runs a sustenance wagon during wartime. Set during the Thirty Years War, it acts as a metaphor to any war throughout time. The play shows that people lose sense of their morals during war, through greed of the army sergeants, but also how Courage remains set on providing for the war despite losing her two sons, and get her materialistic cut, knowing that big profits are not made by little people7. There are certain attributes in Mother Courage that exemplify Epic Theatre, the most dominant of these being the character names in the play for example the Cook and the Chaplain. Brecht avoided giving characters actual names as this added to his concept of the Verfremdungseffekt, stopping the audience from becoming emotionally attached to the character. By naming Mother Courage the audience is subconsciously forced to empathise with her, sharing a powerless social position 8. Brecht also created the idea of gestus. Here, the actor adopts a socially critical attitude towards his character, communicating with the audience as himself rather than as the play character. A good example in Mother Courage is a performance by Brechts wife, Helen Weigel. When asked to identify her son at the end of scene three, the stage directions instruct Courage to shake her head, to show she doesnt recognise her son. However, after doing this, Weigel turned to the audience, opening her mouth in a silent scream. This reminded the audience they were spectators at the theatre, another of Brechts aims, but also had more affect on the audience than any real scream could have. It is for this reason that Mother Courage was both a success and ineffectual for Brecht. Audiences always felt some emotion towards Courage, yet the play was well received. Brecht included a number of songs in his play, and the actors would step out of character to perform these, adding to the Verfremdungseffekt. He wanted the music and text to juxtapose one another, such as when Yvette teaches Kattrin about love in the Fraternization Song. Political Theatre played a key role in the development of Modernism as a whole, Brecht being the most influential character, but was also fundamental in the development of theatre. Remains of Political Theatre can be seen across the Arts today, and the sub-movement has been continued by such political writers as Edward Bond who said that theatre helps us to understand political views, complimenting the work of Brecht and Piscator. Despite being experimental and controversial, Political Theatre is now regarded with great respect and well received. Therefore, Brechts ingenious but contentious ideology came true for him, and the development of Modern Theatre: Dont start from the good old things, but the bad new ones. References 1. Indecision, Hesitation and Delay in Shakespeares Hamlet - Procrastination :: GCSE Coursework Shakespeare Hamlet

Hamlet's Procrastination In William Shakespeare’s Hamlet, Hamlet’s tragic flaw is his procrastination. From the first time Hamlet was acted until now, critics have fought over the reason for Hamlet’s procrastination. Some say that the cause is due to Sigmund Freud’s theory that Hamlet has an "Oedipal Complex," which is his love for his mother. Others argue that he just never finds the right time to carry out the revenge of his father’s murder. The Oedipal Complex theory in regard to Hamlet’s situation seems more likely because of the amount of times Hamlet has to kill Claudius but always fins a reason not to kill him. If it is not the case, then the cause of the procrastination remains a mystery. There is no reason for Hamlet not to kill Claudius, whom he hates, and was ordered by a higher power to destroy, other than the fact that subconsciously, Hamlet needed Claudius to keep him away from his mother. Hamlet procrastinated only because of his fear of intimacy with his mother, knowing that Claudius was the only person separating he and Gertrude. Although Hamlet has a pious duty to avenge his father’s murder, his desire for his mother is too strong for him to leave an open pathway to her. He tries to find excuses to postpone his killing Claudius. First, he tries to discover whether or not Claudius really did kill King Hamlet, which gives him some time. After he has convinced himself that Claudius is to blame, he attempts to murder him just twice. The first time, he finds Claudius praying, and uses that as a scapegoat so he can again put off his pious duty. Later when he is alone with Gertrude, he thinks that Claudius is behind the curtains, and kills the man there. Unfortunately, Polonius becomes the victim of Hamlet’s dagger. The only time when Hamlet does not hesitate to carry out his pious duty is when he is in the bedroom with Gertrude. Unfortunately by mere coincidence, Polonius is the man behind the bedroom curtain, not Claudius. Hamlet stabs Polonius instinctively because he is where he truly desires to be, with his mother. This is the only time when Hamlet actually has the courage to try to kill Claudius, thus opening the path to Gertrude. All of the other times in the play, Hamlet is either alone or with people who he needs to hide his desire from.

Every other one was able to be cleaned up, yet we can’t seem to stop this oil slick from reaching the shore. The spill covers more than 4,000 square miles of ocean surface, which is over ten times the area of New York City. It threatens the coasts of Texas, Louisiana, Mississippi, Alabama, and Florida. There are many volunteers trying to stop the oil from hitting these coasts, but ho w long can that last? I, personally, approve of off-shore drilling, but we need to have precautions set up to keep things like this from happening. This is hurting wildlife, as well as the industries to fish for shrimp in the area. I think that BP needs to cap this well soon, because we can’t just leave it the way it is.
